Work Injury

When most people think about workplace injuries, they think of workers' compensation laws. Unfortunately, under workers' comp weekly payments are often low, usually are limited in duration, and do not necessarily provide any form of lump sum payment, even if fault can be proven. Believe it or not, there is generally nothing provided for pain and suffering or losses to family members. This is true even in the case of amputated limbs, brain damage, and quadriplegia!

In a serious work related injury case is critical to have your lawyer search for what are known as "third party actions". These are cases which can be brought in addition to and simultaneous to a workers' compensation case, in a separate Court, in order to obtain fair compensation, without the limitations of workers comp. An accident victim limited to tens of thousands of dollars paid out over a long period of time may receive millions paid all at once if the proper third party actions can be identified and litigated properly.

This is often an extremely complex and difficult process. It also takes resources, and a considerable expenditure of time. However, third party actions can include recovery for pain and suffering and future damages. Often these third party cases are difficult to detect and require a great deal of work, however, your case may have underlying causes of action, based upon theories of
product liability and premises liability.
